ATF Announces Major NFA Update
Suppressors and SBRs No Longer Require Federal Approval Under New Guidance
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) announced a major update to the National Firearms Act (NFA) on October 9, 2026, stating that it will no longer enforce certain federal approval, registration, and tax-stamp requirements for suppressors, short-barreled rifles (SBRs), short-barreled shotguns (SBSs), and certain other weapons (AOWs).
The decision follows a federal court ruling and the Department of Justice's decision not to appeal. Under the new guidance, ATF will extend its non-enforcement policy nationwide for the covered items.
Our team at Armax United is breaking it down.
What Does the NFA Update Mean?

Under the updated federal guidance, individuals no longer need to obtain prior ATF approval or comply with the NFA's federal registration and tax-stamp requirements for the covered items under the agency's non-enforcement policy.
The change follows earlier legislation that reduced the federal making and transfer taxes on these items to $0. The new guidance goes further by addressing the enforcement of associated approval and registration requirements.
Background Checks and State Laws Still Apply
The update does not mean that all firearm regulations have disappeared. Federal firearms laws under the Gun Control Act remain in effect, including applicable background checks, Form 4473 requirements, and dealer recordkeeping.
State and local laws may also impose separate restrictions on suppressors, short-barreled rifles (SBR)s, short-barreled shotguns, and other covered firearms. Gun owners should review the laws in their jurisdiction before purchasing, making, transferring, or possessing these items.
The $200 federal tax and applicable NFA requirements also remain in place for machine guns and destructive devices.
What Happens Next?
The ATF's October 9 guidance represents a significant change in federal enforcement policy for several categories of NFA-regulated firearms and devices. Dealers and consumers should consult the agency's official guidance for details about transfers, possession, manufacturing, and other requirements that may affect their circumstances.
For firearm owners and the firearms industry, the announcement marks a major development in the ongoing legal debate surrounding the National Firearms Act.
